IGNORANCE OF THE LAW DOES NOT EXCUSE- HE WHO ALLEGES "DURESS" HAS THE BURDEN TO PROVE IT! ~Prof Nnam di Obiaraeri Wrote

Image
V ...Acting under a sense of duty and to enlighten an otherwise legally ignorant audience, we make bold to explain that under the law, "duress" is a vitiating element to an already completed act or action. The rebuttable presumption of the law is that everyone is bound by his document or act. The Returning Officer is bound by the Senatorial election result he declared. The legal defence of "duress" is asserted to negative the bindingness of an already completed act or action. Therefore, he who asserts duress must prove it with cogent, credible and verifiable evidence. The burden of proof of duress therefore rests squarely on the said Returning Officer. It is indubitable that the said Returning Officer certainly does not understand what amounts to "duress" in law as there was clearly no scintilla of evidence of "duress" in the circumstance before and leading to the declaration of the result. From our adjectival or evidentiary law pos

IMO GUBER: GOV OKOROCHA'S PAINS & MADUMERE'S GAINS. - written by Esogibe Ikenna

In the Igbo proverbial lyrics, "a deaf fly follows the corpse to the grave". The onetime flamboyant and bubbling but outgoing executive Governor of Imo State, Rochas Okorocha had boasted and sworn to relegate or retire every politician in the state after the 2019 election. Little wondered why and how the killer was suddenly killed. The Bible says that on the exit of Pharaoh, the Israelites felt relieved and there was joy in heaven that the oppressors of children of God were put to shame for the spell they cast against the innocence. However, there is no doubt that today in Imo state, every Dick and Harry are happy, majority of them have placed their expectations that better days are ahead after the handover in May 29th, 2019. But one thing remains sacrosanct and there is need to place it on board for Imo people to be aware how the journey of grace and libration in the state started. As a man of integrity, humble and forthright, the Deputy Governor of Imo State, Pri

Imo 2019: Between Goliath & David- Why Eze Madumere Defeated Gov Okorocha In One Blow. - written by Esogibe Ikenna

The 2019 Governorship election in Imo state was a test case for power play between Governor Rochas Okorocha as (Goliath) and his Deputy, Prince Eze Madumere as (David). The exercise confirmed the saying that those who talk much have little or no power coordination to make an enroll. From the onset, every Dick and Harry had concluded that Governor Okorocha was cruising to victory after reversing an already summed up party congress withing APC. Just as the Bible made me to understand that "surely they shall gather but anyone that gathers against you shall fall for thy sake", this is indeed the summary of Governor Okorocha's jigims. The lesson of 2019 election in Imo state shows that no one makes his or herself god when the true God has said nothing. Why Okorocha's failure does not hinder anyone's sleep is because everyone prayed that he and his cronies be booted out from the state seat of power. As a personal Chief Strategist, Chief of Staff and M

LEGAL REMEDY FOR ADULTERY IS NOT RESORT TO TORTURE, DEGRADING AND INHUMAN TREATMENT OF AN ADULTEROUS PARTY! - By Prof Nnamdi Obiaraeri.

Prof. N. Obiaraeri & Gov. Rochas LEGAL REMEDY FOR ADULTERY IS NOT RESORT TO TORTURE, DEGRADING AND INHUMAN TREATMENT OF AN ADULTEROUS PARTY! Our attention has been drawn to the trending online video of an explicitly nude and violent scenes of an alleged adulterous female paraded while being tortured naked (something near pornography) but raising concerns of grave human rights abuse and indignity of the human person. In the said video, a lady that was allegedly caught in an  adulterous liaison in the matrimonial home of another woman was stripped naked, thoroughly whipped on bare buttocks and all over her body and subsequently paraded naked on the street by a woman who claimed to be the sister of the aggrieved woman. We ask, is this line of action allowed under our laws as the welter of online reactions on this matter leaves much to be desired? As usual, opinions are ignorantly divided with some gloating and cursing the female victim and suggesting that she deserved wha

THE LAGOS BOYS WITH THEIR GOVERNMENT OF EXTORTION: THEY ARE NOW AT THE CENTER WITH VAT. - written by KEMKA S. IBEJI

THE LAGOS BOYS WITH THEIR GOVERNMENT OF EXTORTION: THEY ARE NOW AT THE CENTER WITH VAT The Lagos boys don't know else than extortion! They have never run a successful business. And who doesn't know that government is the biggest business. Government is the business that runs the rest businesses. This is why I hated the PDP back in the days of Labaran Maku who kept telling Nigerians that government has no business in business. Sad they're handling this economy under PMB - the Lagos boys! Do you know that the biggest business in Lagos is touting (agbero)? Whether it is at the motor park, junction, in the market, school, football field, along the road, or anywhere else you can imagine, the are doing their deal - just touting! You need to see the crop of youngsters here who have destroyed themselves with drug abuse and alcoholism. They have been abused by the political leadership which believes in using the young people. Hoarse voices, cracked gaits, staggered

THE VICTIM OF EVIL PROPAGANDA IN RIVERS STATE POLITICS: RT. HON. ROTIMI CHIBUIKE AMAECHI

Image
HE Rotimi Amaechi  Dame Patience & GEJ  HE Nyesom Wike  THE VICTIM OF EVIL PROPAGANDA IN RIVERS STATE POLITICS: RT. HON. ROTIMI CHIBUIKE AMAECHI. I have read lots of write-ups about and against the current Minister of Transportation and former Governor of Rivers State. I have severally interacted with many intelligent critics of Rt. Hon. Rotimi Chibuike Amaechi who argue bitterly against him. I have read and listened to the many news around him and the current Governor of Rivers State - His Excellency Ezenwo Nyesom Wike. One thing underlies the entire situation; someone has or few groups have manipulated the media against Rotimi Chibuike Amaechi and he has suffered the punishment of the real tormentor(s). Why and what is their reason for this condemnable machinations? Somehow, I found out that this same Rotimi Chibuike Amaechi was once celebrated among his people and the entire Nigeria as the Best Governor. He at some time was known as a fearless and great leade

IMO IGR AGAINST THE VANDALISM OF ROCHAS OKOROCHA AND FAMILY! By KEMKA SOLOMON IBEJI

IMO IGR AGAINST THE VANDALISM OF ROCHAS OKOROCHA AND FAMILY! Let's cry for Imo State! Let's cry for Imo State!! Let's cry for Imo State!!! In the collapse of Abia State and Rivers State orchestrated by massive violent crimes such as the spate of armed robbery, assassinations and kidnapping cases, Imo State grew as the bride of all states in the South-East and South-South especially. Imo State took over tourism and hospitality. Owerri became the headquarters of happiness and love in Nigeria. This happened at the feet of an ungrateful Governor Rochas Okorocha. Dr. Ikedi Ohakim prepared the ground for Imo greatness. He started the beautification of Imo State. He created waste management sector that could compare with any such across the globe. Dr. Ikedi Ohakim got the state ready for internal and state-of-the-art infrastructural maintenance outfit. Shame on Rochas Okorocha and his family! Let's cry aloud Ndi Imo. Today, we read that Enugu State has IG

AS HOPE ARRIVES, NEVER DESPAIR! A Piece from Legislative pragmatism. - KEMKA SOLOMON IBEJI

AS HOPE ARRIVES, NEVER DESPAIR! A Piece from Legislative pragmatism... As the morning star rises And the sunshine slits in I could imagine tomorrow of our land Gazing at yonder years The burdens of past undone The hip of works lying in wait I could pray for the wisdom to labour Whereas we aim at the future The future lies in the scrolls; the architecture of letters The learning of the young and infants The tomorrow personified How dead the future seems; so silent and frightened The broken pieces and fallen walls of learning The null of the teaching class How else do we hope for the future? The sight of expectant mothers A reminder of possible dirge; an epitaph? Who knows who lives amongst the two? Mother or foetus? Our sick rest on faith What if God keeps silent? When it is the duty of men Our hope is faith or death In the days of abundance Our fields were green and the pastures smiled Our palm trees rained reds in fruitfulness Our tables knew no lack

BE A PARTY TO THE SOCIAL CONTRACT: AHIAZU/EZINIHITTE FEDERAL CONSTITUENCY IS CALLING FOR YOUR STAKE NOW! - Written by KEMKA SOLOMON IBEJI

BE A PARTY TO THE SOCIAL CONTRACT: AHIAZU/EZINIHITTE FEDERAL CONSTITUENCY IS CALLING FOR YOUR STAKE NOW! The Trinitarian social contractarians - Thomas Hobbes, John Locke and Jean Jacques Rousseau - idealized the state of nature. Though with variants, their angular parallax held crux on the need for reasonable and peaceful cohabitation of human kind in a society. In this understanding, the contract came alive as a bond of responsibility for all citizens in the commonwealth. This however ushers in the current day government variously referred to as the Leviathan or the Sovereign and otherwise. In the arms of the leviathan or sovereign was the common will of the constituents of the commonwealth deposited for administration. This is the magic of government and the obedience strongly and inseparably tied to it. Call it a myth, an allegory, epic, a fable, an imagination or a fiction, the fact is that the act and art of leadership has come to stay and your stake is in it. What s

OUR GIFT TO OUR PEOPLE: EDUCATION OF THE ELECTORATE - KEMKA SOLOMON IBEJI

OUR GIFT TO OUR PEOPLE: EDUCATION OF THE ELECTORATE. Dear Team Mates in the project to make Ahiazu/Ezinihitte Mbaise Federal Constituency a better place in 2019 and fellow compatriots, as the time draws nigh, the fears of the wickedness of ignorance heighten. I call to memory certain issues as vote buying or vote sales and purchase, political thuggery, voters apathy and essentially unknown candidates. By unknown candidates, I mean the common experience where people come out on election day and they don't have anybody in mind to vote for. This concept of unknown candidates engenders and fertilizes vote buying. Of course, it is cheaper to buy someone who has nobody in mind to vote for on the election day. In addition to the foregoing outlined wickedness of ignorance with regard to elections, the worst is the reigning concept of "DESPERATE PHILANTHROPISM" which some have severally tagged "Emergency Philanthropy" of emergency philanthropists. I will not wan

I WON AND WE SHALL FIGHT AGAIN! - Written by KEMKA SOLOMON IBEJI

I WON AND WE SHALL FIGHT AGAIN! My greatest take-home is the experience. Though very costly in terms of finance but worthwhile for the purposes of times ahead. My stake is to make best use of it! I won and we shall fight again! Yes, I set out on the mantra of building strength for political morality; I will not buy votes! It got so tempting at some point that my morality was intensely under severe test and pressure. But indeed, I won and we shall fight again! I won knowledge! Today I know INEC, I know our electorate, I know our political parties, I know political groupings called structures, I know loss and I know victory. In the field, I met with friends, I also met foes. I shook the rich and also befriended the lowly. I saw faithfulness and fearlessly slept with betrayals. I appreciated truth and honesty while unknotting insincerity and deceitfulness. I won and we shall fight again! The sounds of victory is sweet but the wisdom in loss is weightier and indeed greater.

CONGRATULATIONS TO AHIAZU/EZINIHITTE MBAISE FEDERAL CONSTITUENCY! - Written by KEMKA SOLOMON IBEJI

Image
CONGRATULATIONS TO AHIAZU/EZINIHITTE MBAISE FEDERAL CONSTITUENCY! It was a weighty span. We fought like men but one must win. Here the people won! Though tainted with lots of irregularities, we however know where it swung. Congratulations to Ahiazu/Ezinihitte Mbaise Federal constituency! We could press for lots but it is needless at the moment. However, I am intensely indebted to our team who are essentially volunteers. These visionaries invested their ideas, time and priceless resources to this light that has been ignited. I assure you that this little light will blossom into flames of international reckoning. This foray, I could simply aver, is a harvest of the youth intelligentsia starting from our purview and an institution of a rare movement to note in times ahead. Fiercely prosecuted from point of glaring obscurity to this spot of sincere pride, our people have through this outing won a game of knowledge implants. Lessons have been learnt and we shall revisit our dr

NEVER UNDER FUSS OR FRETZ; WE SHALL REMAIN NOBLE AS KINGS AND QUEENS! Written by KEMKA SOLOMON IBEJI

NEVER UNDER FUSS OR FRETZ; WE SHALL REMAIN NOBLE AS KINGS AND QUEENS! We have learnt to live with all; friends and foes alike. God created us all but with difference in quality. Never worry about those who may never climb! Some lose the substance of their own existence for reasons so cheap and unknowingly that's gone. Even amongst the gods, class has overgrown the realms of ideas and now has become (and not merely have assumed) a reality. Don't stop saying it; humans are segregated by qualities into classes. I will, throughout my lifetime, love and respect men and women of responsibility; those who can always stand on a standpoint and follow same to its logical conclusion. In this current leadership exploit, I have come across a few and I will live to honour them and their likes to come. It is manly to have a course and a point of view and not windy directionlessly. Let's not get bothered about men and women who have no strength of mores and who cannot die for a

THE PROVISOS OF PRESIDENTIAL ELECTION VICTORY AND THE UNIMPORTANCE OF THE SOUTH-EAST/ SOUTH-SOUTH: A SUPER GRANTING OF BIAFRAN BREAKAWAY - Written by KEMKA S. IBEJI

Yes, in the months behind us today, I engaged political parties and the electorate in a bid to deepen democracy and better the lots of our people in Ahiazu/Ezinihitte Mbaise Federal constituency, Mbaise nation, Igboland, Nigeria and Africa by extension. Yes, I did! I pursued this dream angling to be a legislator knowing how important the legislature is in a democracy. I also did because I know that Nigeria, and to a greater extent Africa, have no home specific laws. By "home specific laws", I mean that species of norms guiding a society drawn from predominant ancestral and domestic experience. This brings up a challenge I was coming to win in the Federal House of Representatives as a lawmaker; raising laws of our dear nation and Africa on the experiential droppings of our African philosophy. KEMKA S. IBEJI  Philosophy in this purview should mean tradition and culture. In other words, a people's total way of life. In this regard, laws of any nation in this age
