IS IT NOT ABSOLUTELY UNLAWFUL FOR THE NIGERIAN JUDICIARY, THE ENTIRE COURTS AND JUDGES IN NIGERIA WHO ARE A PARTY TO THE CASE TO SIT AS THE ADJUDICATOR AS WELL? A CONTEMPLATION OF A LAW OF LAWS IN THE CASE OF DELE FAROTIMI VS AFE BABALOLA. Written by KEMKA S. IBEJI

It is trite to legal commonsense that no system judges itself. And as the legal dictum states in the Latin phrase "Nemo judex in causa sua" that translates to "no one should be a judge in their own case". It's a fundamental principle of natural justice and constitutionalism that ensures impartiality in legal proceedings. The principle of nemo judex in causa sua originated in Roman law and was crystallized into a phrase by Edward Coke in the 17th century. It is however enshrined and found in legal systems around the world.  When the judiciary, including courts, judges, or lawyers, is accused as a party to a case, this creates a significant conflict, not only of interest but, populates the national social and political landscape with legalistic mines and destructive sands of natural law fabrics. Assuming you are a judge and eventually is caught in a crime, irrespective of the enormity, and the case is brought to you to judge yourself, what do you think you will do...

It's a den like terrible here  It's difficult not to think this Everyone here is a criminal  Everyone is encouraged to be Our money houses are extortionate  Our safe keepers are quiet robbers  Our will custodian is a treachery  The crown looks like a crook  Our lives are in utter danger Justice sings elegy and dirge  Its temple is a bazaar mall Why not call it a supermarket? Judgements are wares in shelves  We hope for a showroom soon  The priests and priestesses war The bounty is prize for the winner  The bench and bar cook us a meal The meal is injustice Shame took a flight  Constable and his masters kidnap  Our weapons to protect are nightmares  The state of nature is a joke  We live in the nature of state  The sovereign relishes all We may never get well, not soon  Wake me up from this sleep The dreams are after my life  It's insipid living in such a time  Livid? It won't serve either  Let...

It's severally too wrong from those saying that Peter Obi wouldn't have dared the reforms that Chief Asiwaju Bola Ahmed Tinubu is attempting. The point is that the reforms are premature and malicious. They're malicious because the ruler is a tribalist and doesn't care about the rest of the country. He's on the Nigerian table to administer the Yorubas and nothing more or less. The pure and clear knowledge is that Peter Obi would have prepared the ground and make it ripe for the reform such that it won't be like a punitive association where one man is seen clearing the table into his bag while others starve home. Those who are also building the economy of Lagos come from the East, West, North and South. Most times I think the recent leadership of Nigeria lack so much in ideology. They run our communities and society without a philosophy. It was Bertrand Russell who averred that "The man who has no tincture of philosophy goes through life imprisoned in the pr...
